A judge has rejected the request of a woman who fled an abusive husband to sue him for child support.
The case is of particular interest in Utah because of a state law that allows people to avoid paying child support until they are convicted of a felony.
Sandra L. "Peggy" Benally fled her Utah husband in 1997. He is charged with aggravated assault, making bomb threats and causing her to be harassed.
Benally asked the court to assume custody of her three children and ordered the man to pay $12,000 a year in child support.
If she won, Benally would have been allowed to avoid child support until her husband was convicted of a felony.
But she was denied custody, and a judge ruled that she had left Utah voluntarily and that she was not legally entitled to child support payments.
"It's not really a legal issue," said Danielle Anderson, a law professor at the University of Utah. "It's an issue of equity. If Peggy Benally was a citizen of Utah and left, the state can't ask for the return of her children."
Anderson said the case would have been "a good question" for the U.S. Supreme Court to rule on, but the court has refused to review it.
Benally's attorney said the children would be better off with their mother, but he argued that Peggy Benally should be treated like any other mother who takes her children with her when she moves.
"He knew he had rights," said attorney Bill Henneke. "He knew when he went to court that he had the right to seek custody. He had the right to live with the children."
After filing for divorce in 1997, the couple had four children.
The two youngest children were born before Peggy Benally left.
The court awarded custody of the two younger children to Peggy Benally and an order that Robert Benally pay $4,000 a month in child support.
Peggy Benally moved to Arizona, where she worked in a used car lot for a few months and then worked in construction.
